NOVEMBER 5, 2001

 

A Regular Meeting of the Flushing Planning Commission was called to order by Chairperson   Robert Matsko on November 5, 2001 at 7:30 P.M. at City Hall.

          MOTION by Fesmire, supported by Gault, to approve the minutes of October 1, 2001 as written.

New Business:         PUBLIC HEARING – SPECIAL USE PERMIT –

                                                                   1401 & 1403 Cedarwood Dr

                                                                      55-25-400-010      

 

          MOTION by Gault, supported by Johnson, to approve the Special Use Permit for

                   1401 & 1403 Cedarwood Drive as requested with the following conditions:

1.      Provide a copy of the deed restrictions that cover the joint common wall maintenance.

2.      Provide a signed “Hold harmless agreement” for the joint sewer line

maintenance or repair. This will be signed by the buyers and filed with the Register of Deeds office.

          Motion carried.

 

Discussion:

• Diane Bruner, Century 21 Woodland, spoke to the Commission regarding this item and the previous approval for a special use permit for 1407 & 1409 Cedarwood Dr.
• Mr. Johnson asked for a copy of the Deed Restrictions for this application.
• Mr. Mantei, the builder, stated he has paid for two sewer fees, one for each unit.  The line however, goes to a section of 6” common pipe that then connects to the City sewer line.  He also stated each sewer line has a back flow preventing device in place.

 

New Business:         INTERNATIONAL PROPERTY MAINTENANCE CODE

 

                   MOTION by Johnson, supported by Gault, to endorse the International

                             Property Maintenance Code and refer this to City Council for approval.

                   Motion carried.

Discussion:

• Mr. Gault voiced his concerns regarding the strict requirements in this document.  It is not possible to amend anything in this code, it must be adopted as written.
• Mr. Rob Kehoe, 1014 Skyview Drive, does code enforcement work for other municipalities and he advised the Commission that other municipalities have adopted this code to regulate possible blight and other code enforcement problems. He recommends adoption of this code as written.

Old Business:          CAPITAL IMPROVEMENT PLAN

 

Discussion:

• Commission is referring this to the City Manager to have changes made:
1. Add cost estimates to all items.

      2.  Remove any completed items.

• Mr. Johnson stated he believes the Commission should be looking at future projects and needs of the City.  The items on the Capital Improvement Plan list have already been identified.
• The commission agreed that the four or six  items regarding the new Police Station and City Hall and the uses for the existing buildings should be grouped together for consideration.
• Mr. Gault asked for clarification on the item “Consider thin paving technique at $90,000.00.”

 

Old Business:          ZONING ORDINANCE REVISION

 

Discussion:

• Commission is recommending rewording “Automobile For Sale” the last sentence. “The permission of the lot owner shall be obtained, in writing, for the automobile parked for sale.”
• The Commission questioned if this ordinance should address other items for sale such as boats, motor homes, snowmobiles and motorcycles etc.
• Correct the typo in D-8 “with” to “within”.
• Limit the number of sandwich board signs on the street at one time.
• Procedure for permit application and fee amounts?
• How long can a sign remain out on the sidewalk?  One week?  30 days?
