A Regular Meeting of the Flushing City Council was called to order on Monday, October 28, 2002 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

Approval of Agenda – Motion by Szukhent, seconded by Gault, to approve the October 28, 2002 agenda as presented.

MEETING OPEN TO THE PUBLIC:
Elva Cook addressed City Council.
PRESENTATIONS:
November 2002 Ballot Proposals – Mr. Don Stypula, Michigan Municipal League, reviewed ballot proposals. 2: This proposal asks voters to authorize the sale of up to $1 billion in state general obligation bonds over the next ten years to provide low-interest loans to cities, villages, townships and counties to finance much-needed improvements to their wastewater collection and treatment systems.

Consent Agenda – Motion by Szukhent, seconded by Bade, to approve the consent agenda: City Council Minutes (October 14, 2002 Regular Meeting), City Council Minutes (October 14, 2002 Closed Session) and October 28, 2002 Council Bills List.

PUBLIC
HEARINGS:
Community Development Block Grant (CDBG) Funds – The City previously allocated 2002 Community Development funds for barrier-free access along the trailway. In order to utilize funds for this project, all easements must be obtained and 50% of the project completed by April, 2003. The project cannot be completed in this time frame; therefore, administration is requesting authorization to reprogram these previously allocated funds.
The Mayor opened the public hearing to the audience.
Elva Cook commented on the use of Community Development funds.
The Mayor closed this portion of the public hearing.
Community Development Block Grant Funds – Motion by Johnson, seconded by Gault, to program $38,404.00 in Community Development Block Grant funds for an elevator in City Hall. These funds include $29,092.00 in unallocated funds and $9,312.00 from project #02-03 Demolition.

Reschedule November 11, 2002 City Council Meeting – Motion by Bade, seconded by Johnson, to reschedule the first Council meeting in November to Tuesday, November 12, 2002 at 7:30 p.m.

PURCHASES:
Morrish Road Culvert – Motion by Johnson, seconded by Gault, to accept Heystek Contracting Inc.’s bid for the Morrish Road Culvert extension project in the amount of $97,472.50.

Telecommunications Ordinance – Motion by Gault, seconded by Bade, to move to second reading and adoption, an amendment to Telecommunications Ordinance No. 121.

Cemetery Ordinance – Motion by Szukhent, seconded by Salem, to move to first reading, Cemetery Ordinance No. 95, as amended, and to issue a moratorium on grave sales until new rates have been approved. The rate schedule will be revised to allow City Council to adjust rates by resolution, rather than make changes to the ordinance itself.

Zoning Ordinance – Motion by Girard, seconded by Gault, to move to first reading the Zoning Ordinance along with the related map, as revised, with the addition of a definition for “Independent Living Units” and the addition of Section 153.901 J (2) – The maximum number of bedrooms per boarding house shall be six (6).
