A Regular Meeting of the Flushing City Council was called to order on Monday, October 13, 2003 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

Excused Absence – Motion by Szukhent, seconded by Gault, to excuse the absence of Councilperson Johnson.

Suspension of Council Rules – Motion by Szukhent, seconded by Gault, to suspend the Council Rules and allow Presentations, Consent Agenda, and item E-1 before Meeting Open To The Public.

            Motion Carried.

 

Approval of Agenda – Motion by Szukhent, seconded by Gault, to approve the October 13, 2003 agenda as amended.

PRESENTATIONS:

 

S.A.L.T. Presentations – Mr. Jerome Hudson, representing S.A.L.T., presented Dan Borgerding and John Delehanty with plaques thanking them for five years of support and their donations of office space and vehicles for the S.A.L.T. program.  The Police Department was also presented with a plaque for their guidance and assistance to the S.A.L.T. volunteers.

2004, 33,000#, GVW Cab/Chassis – Motion by Bade, seconded by Gault, to award the bid for a 2004, 33,000 pound truck with dump box and underbody scraper, to Graff Truck Center and Cannon Equipment, in an amount not to exceed $73,870.00.

Mr. Henneke, City Attorney, addressed the situation with crossing guard Kelly Sumner.  Ms. Sumner was allegedly hit by a car while attempting to cross children at her intersection.  She had requested that the driver be ticketed.  Mr. Henneke said that in cases like this, the city attorney reviews the investigation that has been conducted to date, so that a determination can be made as to whether a viable case can be made.  He stated that there are matters of evidence that need to be present in order to prosecute on a case.  Mr. Henneke had reviewed a number of things:  the police report, several diagrams, and participated in interviewing one of the witnesses to determine whether or not the claims of what happened actually appeared to have happened and whether the evidence could substantiate those claims or not.  In this case, it was Mr. Henneke’s opinion that the claims could not be substantiated.  There were several inconsistencies in the claim.  Because of the findings, the City Attorney’s office declined to authorize a ticket in this case.

 

            Chief Peek detailed the procedure that police officers must follow before tickets can be issued.
