A Regular Meeting of the Flushing City Council was called to order on Monday, October 27, 2003 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

Addition to Agenda – Motion by Gault, seconded by Bade, to add a Closed Session to the agenda to discuss pending litigation.

PRESENTATIONS:
The 2002-2003 Audit, to be presented by BKR Dupuis & Ryden, was removed from the agenda and moved to the November 10, 2003 meeting.
CONSENT AGENDA – Motion by Szukhent, seconded by Bade, to approve City Council Minutes (October 13, 2003 Regular Meeting) and the October 27, 2003 Council Bills List.

Stock Sale – Motion by Bade, seconded by Gault, to approve the sale of stock certificates granted to the City through the Will of Elizabeth Stankwitz.

BID/AWARD
PURCHASES:
City Hall/Police Station Re-Bids – Mr. Don Lee, of THA Architects, was in attendance at the meeting to answer questions regarding the background check performed on Direct Building Development, the low bidder on the construction of the City Hall/Police Station. Mr. Lee reported that although the company is fairly new, the owner is very experienced and has been responsible for many large projects. Direct Building Development is bonded for $3,000,000.00
Administration recommends that alternates one and four be considered within the next thirty days. Input from the contractor and architect will be considered before a final recommendation is made to City Council.
City Hall/Police Station Re-Bids – Motion by Johnson, seconded by Gault, to approve the contract for the construction of a new City Hall/Police Station between the City of Flushing and Direct Building Development, LLC, in the amount of $1,489,000.00 and authorize the Mayor and City Clerk/Treasurer to sign the contract on behalf of the City of Flushing, subject to the following conditions:
1. That the city attorney review and approve all documents, including the bid specifications and financing documentation.
2. That the city attorney renders a favorable legal opinion pertaining to compliance with all applicable financing laws.

3. That the City Council approve the financing of the building in accordance with the city attorney’s legal opinion.
4. That Direct Building Development, LLC provides all documentation relative to bonding requirements, as required by the bid specifications, which were due October 22, 2003.

Closed Session – Motion by Szukhent, seconded by Gault, that pursuant to the Open Meetings Act, we go into closed session to consult with the City’s attorney regarding trial settlement strategy in connection with the case Warda vs. City of Flushing, as an open meeting would have a detrimental financial effect on the City’s litigation and settlement position.
