A Regular Meeting of the Flushing City Council was called to order on Monday, May 24, 2004, at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

PUBLIC HEARINGS:

 

Property Tax Increase to Continue a Police Liaison Officer in the Flushing Community School District – At the Flushing City Council meeting of May 10, 2004, a ballot proposal was offered for consideration, which would increase the City Ad Valorem taxes by .5 mil, to continue a Police Liaison Officer and DARE program at the Flushing Community Schools.  The ballot proposal would read:

 

                        Shall the current taxes assessed within the City of Flushing be increased by .5 mils to continue a police liaison officer in the Flushing Community School District?

 

If approved, this increase will not exceed the fifteen (15) mils on each dollar of assessed valuation of property as finally equalized and authorized by law.  This notice was published in the Flint Journal on May 17, 2004.  The proposed millage rate, if approved, would be increased by .5 mil, and be established at 10.5934. 

 

In order to place this ballot on the August Primary Ballot, the City Council must approve the levy of the additional millage rate pending the results of the August vote.

 

The Mayor opened the public hearing to the audience.

G.F.W.C. Flushing Women’s Club – Motion by Johnson, seconded by Gault, to approve the Flushing Women’s Club request for the reservation of Riverview Park, pavilion and Bandshell on Saturday, June 5, 2004 for the 38th annual “Art In The Park.”

Flushing Area Chamber of Commerce – Request to Hold the Rock & Roll Oldies Festival in Riverview Park – Motion by Peck, seconded by Bade, to approve the Flushing Area Chamber of Commerce request for the use of Riverview Park for the annual summer festival known as Flushing’s Rock & Roll Oldies Festival, June 9 through June 13, 2004.

REPORTS:

 

Woodland Ponds Force Main - During construction of the Woodland Ponds development, administration became aware of problems with the location of an easement for a sewer force main that was constructed in 1971.  That force main was originally to be located in an area of the former Popovits property that is currently part of a pond.  During construction of the sewer system, the force main was built south of the easement that the City of Flushing possessed. 

 

Mr. Scot Brown, a principal in the development of Woodland Ponds, has requested that the force main be moved to a deeper depth, and re-located outside of the building envelopes of the condominium parcels.  The construction cost of that re-alignment and re-establishment of the easement is expected to be $12,000.00.  Mr. Brown is requesting participation on the part of the City, David Rowe of Inland Seas Engineering, Rowe Incorporated, and himself, to share in the cost of re-establishing that easement and moving the force main outside of the building envelopes of the condominium project.

The City Manager recommends that the City participate in the re-location of that pipeline and re-establishment of an easement with terms that are satisfactory to the city attorney.  He also recommended that the City limit its participation to an amount of no more than $4,000.00, pending receipt of a Hold Harmless Agreement.

 

Woodland Ponds Force Main – Motion by Szukhent, seconded by Gault, to participate in the re-location of a sewer force main and re-establish a properly executed easement with terms that are satisfactory to the city attorney, limiting the City’s contribution to no more than $4,000.00, and receipt of a Hold Harmless Agreement.

BID/AWARD PURCHASES:

 

Purchase of Police Vehicles – Motion by Szukhent, seconded by Salem, to authorize the purchase of two (2) Ford Crown Victoria police cars from Signature Ford L-M Jeep of Owosso, Michigan, at a cost not to exceed $40,784.00.

OLD BUSINESS:

 

Sewer Rate Adjustment – Motion by Gault, seconded by Johnson, to adopt a resolution establishing sewer rates:  $3.74 per thousand gallons of water used, $56.68 per quarter for un-metered city residents, and $66.44 per quarter for un-metered non-residents, effective July 1, 2004.

Special Legal Counsel – Motion by Bade, seconded by Johnson, to authorize the appointment of the legal firm of Bellairs, Dean, Cooley, Siler, Moulton and Smith, LLP to handle the legal issues in conjunction with the floodplain violation as noticed by the Michigan Department of Environmental Quality.
