A Regular Meeting of the Flushing City Council was called to order on Monday, November 8, 2004, at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

PRESENTATIONS:

 

90 E. Main Street – Property Status – Mr. Dan Hammel, TetraTech, gave City Council a report on the status of the cleanup at 90 E. Main Street.  TetraTech is working in conjunction with the Department of Environmental Quality on the cleanup of 90 E. Main Street.  They will have enough of the soil remediated in time for spring construction of the City clock.

COMMUNICATIONS:

 

City of Swartz Creek – Lease, Sanitary Flow Meters – The Swartz Creek City Council voted unanimously to lease their sanitary sewer flow meters to the City of Flushing for one dollar per meter per year.

REPORTS:

 

Lynn Street Closure – The City Manager reported the reasons and ideas that led up to the decision to change the traffic routing on Lynn Street.  Reasons for changing traffic were 1)  safety of residents if paved, 2)  discussion with Lynn Street residents and the bus garage supervisor, 3)  traffic study – end of school year – four weeks for traffic impact – with no resulting impact.  Future study and alternatives will include continued traffic counts, look at alternate traffic ideas and consider continuing Terrace Street through to Seymour Road.

 

City Hall/Police Station Construction – The City Manager reported on the Flushing City Hall/Police Station construction. 

 

            Although the construction schedule is not on time, this project is currently well within the planned budget as originally set.  The original project cost was $1,489,000, with a change authorized at the time of bidding in the amount of $15,928.  That change included a window design modification as well as changes to the soffit materials.  This change started the project out at $1,504,928.  The original budget was set up with a contract estimate of $1,500,000, and a contingency of $100,000.

 

            Since the original start of the project, additional change orders have been executed to accomplish the following:

 

§         A sanitary lead was relocated to enter a lower manhole for drainage;

§         A roof change added a canopy over the City Hall entrance;

§         A public drinking fountain was added to the building lobby;

§         The police evidence room was modified and relocated in the lower level;

§         The carpeting in the patrol room was changed to tile;

§         A concrete wall was added between the hallway and the lower level meeting room;

§         Casework in the police reception room was revised to accommodate the new window;

§         Electrical floor box assemblies were changed in the City Council room.

            While several minor changes were made to the original design, these are the major changes to the building that have created increases and decreases to the project cost.  The net increase in the change orders currently amount to $31,977.43, for a total project cost of $1,536,905.43.  While additional changes may be proposed, we are well within the original budget.

 

            Soils removed from the City Hall site were placed in Riverview Park in order to increase the size of a sledding hill that was constructed several years ago.  The Michigan Department of Environmental Quality (MDEQ) determined that a permit was required to allow the soils in the area of the sledding hill.  As our County Commissioner pointed out, the sledding hill was not properly constructed and this hill would need to be removed.  Since that date, a permit has recently been granted by the MDEQ, and the sledding hill can now be rebuilt in an adjacent area of Riverview Park.

 

            These soils are not contaminated (as reported) and the cost of the soil removal and relocation was borne by the contractor.  The city has not had to pay for any of this cost to date.

 

            Although the construction date is overdue, work is progressing, and is being inspected by both the building inspector and architect at least three times each week.  Some of the work has been rejected and redone, as happens in most construction projects of this size.  Portions of the masonry have not yet been accepted and those remain one of the areas needing corrections.

 

            The balance of the project will continue to be reviewed by the inspectors, as the construction is completed.  Every portion of this project will be completed properly prior to payment or acceptance.

 

BID/AWARD PURCHASES:

 

John Deere Mowing Tractor – Motion by Szukhent, seconded by Gault, to award the bid for a John Deere mowing tractor with a 72 inch mowing deck, 60 inch broom and 47 inch snow blower, to Lawn & Leisure Shop, Flushing, Michigan, in the amount of $24,689.68.

Zoning Ordinance Amendment – Single-Family Residences in the B-1 Zoning District – Motion by Johnson, seconded by Gault, to move to second reading and adoption Zoning Ordinance Amendment – Sections 153.310, Schedule of Uses, and 153.901, Standards.

            Motion Carried.

 

Executive Session – Motion by Szukhent, seconded by Salem, to go into Executive Session to discuss with the attorney some recent developments in the Warda case and to give the attorney guidance in pursuing the matter because of those new activities.
