A Regular Meeting of the Flushing City Council was called to order on Monday, May 23, 2005, at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

Excused Absence – Motion by Szukhent, seconded by Gault, to excuse the absence of Councilperson Bade.

Addition to Agenda – Motion by Gault, seconded by Szukhent, to add the item Popovits vs. City of Flushing to the agenda under Closed Session.

            Motion Carried.

 

Approval of Agenda – Motion by Szukhent, seconded by Gault, to approve the May 23, 2005 agenda as amended.

Consent Agenda – Motion by Szukhent, seconded by Gault, to approve City Council Minutes (May 9, 2005 Regular Meeting) and May 23, 2005 Council Bills List.

COMMUNICATIONS:

 

Sloan Museum – Request to Hold Cruise – The Sloan Museum Auto Fair will be held June 24-26 with the kickoff being the cruise from the Flushing A&W on Friday night.  The route most traveled by the participants will be Flushing Road to Fifth to Longway.

 

REPORTS:

 

Genesee County Metropolitan Planning Commission – Community Development Block Grant (CDBG) Program – Motion by Szukhent, seconded by Mark, to opt out of the Genesee County Community Development Block Grant program for fiscal years 2006-2008 and continue to participate in the State’s Small Cities Program.

            Motion Carried.

 

APPOINTMENTS:

 

City Councilperson – Motion by Gault, seconded by Szukhent, to appoint George Kozan to fill the District 2 Council seat until November 8, 2005.

            Nay:     None

            Motion Carried.

 

The Clerk/Treasurer administered the oath of office to Mr. Kozan.

 

Closed Session – Labor Agreement - Motion by Szukhent, seconded by Gault, that pursuant to the Open Meetings Act compiled laws 15.268(c) to go into closed session to consider strategy connected with negotiating a collective bargaining agreement.

Popovits vs. City of Flushing – Motion by Szukhent, seconded by Mark, that pursuant to the Open Meetings Act to go into closed session to consult with our attorney regarding trial or settlement strategy in connection with the case Popovits vs. City of Flushing, in that an open meeting would have a detrimental financial effect on the litigating or settlement position of the City Council.

 

            Yea:     Gault, Kozan, Mark, Salem, Szukhent, Gensel

            Nay:     None

            Motion Carried.

DPW Union Contract – Motion by Szukhent, seconded by Gault, to direct the City Manager to set a signing date on the Department of Public Works contract of June 1, 2005, or the City will withdraw its offer of retroactive pay on overtime; also, to allow the City Manager to set a date for an impasse.
