A Regular Meeting of the Flushing City Council was called to order on Monday, October 24, 2005 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

COMMUNICATIONS:

 

American Cancer Society – Request to Use Riverview Park – Motion by Szukhent, seconded by Salem, to approve the American Cancer Society’s request to hold the 6th annual Flushing Relay for Life event in Riverview Park on June 16 and 17, 2006.

American Legion Post 283 – Flag Donation and Ceremony – Motion by Bade, seconded by Szukhent, to approve the American Legion Post 283’s offer of the flag donation and ceremony for the new City Hall/Police Station on November 11, 2005 at 11:00 a.m.

REPORTS:

 

125 E. Main Street (Duffy’s Bar) – Motion by Szukhent, seconded by Kozan, to approve a resolution transferring all of the stock in a 2005 Class C Licensed business, located at 125 E. Main Street, Flushing, Michigan 48433, from Alan J. Prosser, to John T. Sperla, Successor Trustee.

Resolution Supporting County Drain Commissioner – At the October 5, 2005 Advisory Committee Meeting, members approved a resolution of support for the Drain Commissioner in the matter of the lawsuit filed by several school districts.  They are asking that this resolution be presented to the City Council for a congruent resolution.

 

            The lawsuit involves a computation that determines measurement of “residential equivalent units” for schools that are charged for sewer connections when new facilities are constructed.  The courts may determine this lawsuit after testimony is taken from engineers that are experienced in these types of measurements.  The City Manager believes that one step in the appeals process has not been completed and, as a result, the administrative remedies have not been exhausted.  He recommended that the city decline support for the resolution at this time.

            Barbara Goebel, Flushing Area Schools Superintendent, attended the City Council meeting to help address the issues that they are facing regarding this lawsuit.

 

BID/AWARD PURCHASES:

 

City Tree Trimming and Stump Removal – Motion by Szukhent, seconded by Gault, to award the bid to provide tree trimming ($89.50/hour) and stump removal ($2.25/inch) services to Aspen Tree Service, Mt. Morris, Michigan.

ORDINANCES:

 

Park Ordinance Amendment – Motion by Bade, seconded by Salem, to move to second reading and adoption an Ordinance to amend Chapter 97 of the City Code of Ordinances, to allow for the regulation of certain uses of the newly created “Flushing Riverview Trail.”

Heavy Business District (B-3) – At the September and October Planning Commission meetings, a public hearing was held to consider the changes to the City of Flushing Zoning Map and District Regulations regarding certain properties with frontage on Seymour Road and Emily Street.

 

            Comments, both written and oral, were solicited through public hearing notices, which were published in the Flint Journal and sent to all property owners within the area of proposed changes.  In addition, all other property owners within three hundred feet of the areas received a notice through the mail.

 

            These changes are the result of the Downtown Development Study, which was completed in April of 2003, suggesting a number of zoning changes to commercial and industrial properties west of the Flint River.  After completion of the public hearing, a new commercial district was proposed to be created, which is intended to accommodate certain types of business uses that “fall between” the uses allowable by the existing B-2 Commercial District and the Industrial District.  Examples of the permissible uses in the B-3 Heavy Business District would be:

            -  Uses similar to an electrician, plumber, and other contractors

            -  Uses that are characterized by a combination of retail and light manufacturing

            -  Automobile wash establishments

            -  Automobile sales and service facilities

 

            In addition to the above types of uses, the following uses were added to the list of staff recommended uses for the district:

 

            -  Restaurants

            -  Drive through establishments

            -  Office uses

            -  Other uses identified by the district regulation charts

 

            A map of the properties included in the recommendation was presented for review.

 

            Upon review of the map and regulations for the (B-3) Heavy Business District, administration will make any council requested modifications to the proposed changes and proceed with a recommendation for a first reading.

 

Heavy Business District (B-3) – Motion by Bade, seconded by Kozan, to postpone action on the Heavy Business District (B-3) zoning ordinance amendment until further review by the City Council.
