Regular Meeting of the Flushing Planning Commission was called to order by
Chairperson Robert Matsko on November
7, 2005 at 7:30 P.M. at City Hall.

HEARING – SPECIAL USE PERMIT

AID DRIVE-THRU)
MOTION by Johnson, supported by Gault, to approve the
Special Use Permit/Site
Plan for
Architects
and Engineers provide the data to Rowe Incorporated on lighting and the turn radius
and also that the cement triangle on the northeast corner be landscaped.

Discussion:
·
Mr. Bow addressed the Commission regarding the
items in the Rowe plan review dated 11/4/05. (Total of five issues.)
·
Mr. Winfield Cooper, Cooper Commercial, spoke to
the Commission regarding the proposed Rite Aid drive-thru and stated:
1.
There
will be an addition of 61 feet of floor space to the west of the existing Rite
Aid store. (Expansion into part of the new plaza.)
2.
The
developers provided a photometric plan of the proposed lighting at the site.
They stated there would be very little difference to the site lighting with the
proposed changes.
3.
They
did not include a cross section of pavement because they are using the existing
pavement.
4.
There
are four stacking places for line up to the drive-thru. They could remove three parking spaces for
stacking area if later they found any problems with stacking/parking.
5.
Height
and Dimension – They are still working on the final design of the drive-thru
because of a floor height difference.

Mr. Johnson asked Mr.
Cooper if perhaps they would consider changing the direction of the drive-thru
to help with the turning radius and stacking area. Mr. Cooper said they had
looked at that possibility and believe this is the
best way to set up the traffic flow.

Mr. Gault stated:
1.
He believes that the
drive-thru plan as presented is safer for pedestrians entering and exiting the
store.
2.
He would like to see
some landscaping in the triangle shown on the plan. Mr. Cooper said if we would like to make
landscaping part of our motion they would be glad to comply.

Business: ZONING ORDINANCE
AMENDMENT –
NON-CONFORMING
LOTS
(Tabled from the 10/3/05 meeting)

Bueche, to remove this item from the table.

MOTION by Johnson, supported by Gault, to recommend to City
Council to add
verbiage to the
Ordinance section 153.1002 as follows:
“In any district in which single-family
dwellings are permitted, notwithstanding
limitations imposed
by other provisions of this ordinance, a single-family
dwelling
and customary accessory building may be erected on any single lot of record or
privately owned outlots that exists at the time of the effective date of
adoption or
amendment of this ordinance but does not meet the required area or
width
requirements. Provided, however, that
all other lot requirements, including required setbacks, are met and subject
to a non-use variance approval
by
the Zoning Board of Appeals.”

Discussion:
·
Mr. Bow spoke to the
Commission regarding the non-conforming lots of record and stated there are
presently two privately owned outlots that will be affected by this possible ordinance
change.
·
Mr. Edward Henneke,
City Attorney, advised the Commission that the Planning Commission can
recommend to City Council to allow these lots to be buildable lots if that is
the conclusion of the Planning Commission, however, Mr. Henneke’s recommendation
would be to consider the Rowe review recommendation to address these lots
through a request for a non use variance on a case by case basis.
·
Mr. Bow stated that
there will only be two possible outlots that will ever be addressed under
whatever way we decide to handle this item.
Any new outlots will dedicated to the City.
·
Mr. Johnson mentioned
that at the last meeting the Commission was in agreement that we probably did
not want to make an ordinance change for just two lots.
·
Mr. Henneke advised the
Commission that we probably should address the verbiage on privately owned
outlots just to allow the Zoning Board of Appeals to address these lots.
(Without the wording there would not be any City entity that could review and
address these lots.)
·
Mr. Olson again stated
that we could recommend:
1.
Not to make any
changes to the Ordinance; or
2.
Modify the Ordinance
to allow the ZBA to address outlots as a non-conforming use variance.

(Motor
vehicle/Motor home)
Discussion only:
·
The Commission
reviewed the Rowe Incorporated memorandum dated 11/4/05. (Clarification of
Motor vehicle/Motor home)
·
Administration will
revise some verbiage and submit it for review at the next Planning Commission
meeting. Some items addressed were:
1.
Add verbiage to allow
parking of recreational vehicles up to 48 hours.
2. Under Definition of Motor Vehicles Note:
Motor home is not considered a motor vehicle for purposes of this Ordinance.

Mr. Bow requested the Commission review the Capital Improvement list
provided in
the packet and make any changes,
deletions or additions for the December Planning
Commission meeting.
