A Regular Meeting of the Flushing City Council was called to order on Monday, November 12, 2007 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

OATHS OF OFFICE – The City Clerk/Treasurer administered the oath of office to Janice Gensel, Mayor, and Councilpersons John C. Gault, Michael T. Szukhent, and Mark F. Brock.

 

Election of Mayor Pro-Tem – Motion by Gault, seconded by Bade, to elect Michael T. Szukhent as Mayor Pro-Tem.

Flushing Area Chamber of Commerce – Motion by Szukhent, seconded by Salem, to approve the request by the Flushing Area Chamber of Commerce to hold the 24th Annual Flushing Community Candlewalk on December 6 and 7, 2007.

Council Rules – The Council Rules also determine the order in which appointments will be made to certain committees.  Committees were selected by Council members on a rotation basis set forth in the rules.  The committee appointments will be as follows:

Fee Schedule – Motion by Bade, seconded by Gault, to adopt a resolution, which will assess a fixed and variable fee structure for permits issued in accordance with Flushing Ordinance Section 99.65(a)3.  The Fixed Permit Application Fee being $25.00 for reviews requiring less than one hour, and Variable Permit Application Fee of $40.00 per hour for those reviews requiring extensive review/research.  Variable Permit Application Fees also include any costs incurred by city engineers and city attorneys.

Main Street Bank Stabilization - Bids were received from five (5) companies for the Main Street Bank Stabilization project.  This project was designed to avoid further erosion problems on the south side of Main Street at the Chamberlain intersection.  The project includes the placement of steel sheeting and the replacement of the existing storm sewer outlet, with further protection through the use of a geo-textile liner and heavy riprap.

 

All companies submitted bids together with appropriate bid bonds. 

 

The ordinance provides that when such bids are submitted, and if the Council shall find any of the bids to be satisfactory, it shall accept same.  The Council shall have the right to reject any or all bids, and to waive irregularities in bidding, and to accept bids, which do not conform in every respect to the bidding requirements. 

 

Due to non-compliance with the bid specification by the low bidder, the city engineer recommended that the second low bidder be awarded this project.  That company is Oak Construction Corporation, and their bid amount was $179,000.00.  The non-compliance involved adherence to a procedure, which requires all bidders to obtain a full set of plans, and provide receipt that they are in possession of the plans.  This is done in order to assure the city that there is no dispute between the contractor’s understanding of the scope of the plan and the engineer’s actual bid specifications.

 

Main Street Bank Stabilization – Motion by Kozan, seconded by Brock, to award the bid for the Main Street bank stabilization project to Oak Construction Corporation of Flushing, Michigan, in the amount of $179,000.00.

City Attorney – Motion by Szukhent, seconded by Gault, to reappoint the law firm of Henneke, McKone, Fraim and Dawes as the City Attorney, and to approve the following fees:

 

            General Matters, Ordinance preparation

            District Court and Consultations                                    $120.00 per hour

 

            Circuit Court, Tax Tribunal, Boundary

            Commission and Appears, etc.                          $130.00 per hour

 

            Monthly retainer                                                           $500.00 for attendance at two

                                                                                                Council meetings per month

Purchase of Property – Motion by Szukhent, seconded by Bade, that, pursuant to the Open Meetings Act compiled laws 15.268(d), to go into closed session to consider the purchase or lease of real property, or the option to purchase or lease real property.
