A Special Meeting of the Flushing City Council was called to order on Thursday, March 27, 2008 at 5:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

MEETING OPEN TO THE PUBLIC:

 

Elva Cook, 1459 Flushing Road, addressed City Council.

 

Hearing Officer Appointment - In accordance with Section 150.92.(D.), a Hearing Officer shall be appointed by the City Council and serve at their pleasure.  The city has not used the provisions of this ordinance in well over twenty (20) years, as buildings have not posed a direct threat to public safety.   

 

The Dangerous Buildings Ordinance requires that, when the city building inspector deems a building to be dangerous or in an unsafe condition, a notice will be prepared and sent to each owner or party in interest in the building.  The notice shall specify a time and place of a hearing, at which time the owner shall have the opportunity to show cause why the building or structure should not be demolished or otherwise made safe.  The hearing officer shall take testimony from both the building owner(s), as well as the property owner(s), in order to make a decision to close the proceeding, or order the building to be demolished or otherwise made safe. 

 

Mr. Charles Rau is a resident of the City of Flushing and has agreed to serve as a Hearing Officer for purposes of this ordinance.  Mr. Rau has experience in enforcing the state building code for the City of Flint since September of 1982.  He is a state certified building official, plan reviewer and fire inspector, and is more than qualified to serve in this position on behalf of the city.

Hearing Officer Appointment – Motion by Szukhent, seconded by Salem, to appoint Charles Rau, of Flushing, Michigan, as the Hearing Officer in accordance with Section 150.92.(D.) of the Flushing Code of Ordinances.

            Nay:     None

            Motion Carried.

 

Adjournment - Motion by Szukhent, seconded by Salem, to adjourn.
