A Special Meeting of the Flushing City Council was called to order on Wednesday, June 25, 2008 at 4:00 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

MEETING
OPEN TO THE PUBLIC:
Elva Cook, 1459 Flushing Road, addressed City Council.
REPORTS:
2008 Street Paving Project - Bids for the 2008 Street Paving Project were received June 20, 2008. The 2008 Street Paving Project encompasses Coutant Street from McKinley Road east to Leland Street. Administration and Rowe Incorporated recommend acceptance of the low bid from Lois Kay Contracting Company. Funds are available for this project through the Street Paving Millage. Administration expects to expand the project east of Leland Street, pending a future change order, which will need to be brought back to city council for consideration. Additional funds in the total street millage are available for this extension, as the bid tabulation, as presented, was significantly lower than the anticipated cost for the project.
2008 Street Paving Project – Motion by Szukhent, seconded by Bade, to accept the bid from Lois Kay Contracting Company for the 2008 Street Paving Project in the amount of $343,451.68.

Special Legal Counsel – Due to a conflict of interest, the city attorney is unable to represent the city, as he also represents a property owner in an appeal to the Michigan Tax Tribunal. The Flushing City Charter allows the city council to retain special legal counsel to handle any matter in which the city has an interest. The city manager contacted Mr. Steve Moulton to begin representation of the city in this matter, as a time deadline requires an answer to the property owner’s petition. Mr. Moulton has indicated that he is not aware of any conflicts of interest, should he represent the city in this matter. His billing rate is One Hundred Fifty ($150.00) Dollars per hour.
Motion by Szukhent, seconded by Bade, to hire the firm of Cooley, Moulton and Smith, LLP, to represent the city for the appeal of MTT Docket No. 0346959, an appeal to the Michigan Tax Tribunal.
