A Regular Meeting of the Flushing City Planning Commission was called to order on Monday, December 1, 2008 at 7:30 p.m. by Chairperson Kevin J. Keane, followed by the Pledge of Allegiance to the Flag.

Approval of Minutes – Motion by Matsko, seconded by Olson, to approve the minutes of the November 3, 2008 Regular Meeting, as written.

MEETING
OPEN TO THE PUBLIC:
Donald Drumm, 2717 Silverstone Lane, Waterford, Michigan 48329, voiced his interest in the item before the commission regarding the proposed language allowing for a mixed residential/office use in the OS-1 District. He stated that it seems there may be a square foot limitation (1500 square feet)?
City Manager Bow replied that it is fifty (50%) percent of the total building size.
Mr. Drumm continued by stating that his building is 1680 square feet and that he would like to review the language prior to commenting further.

NEW BUSINESS:
Public Hearing – Office/Residential Joint Uses - City Manager Dennis Bow gave an overview of the item before the commission that would allow the use of a portion of an office as an accessory residence in the OS-1 district by Special Use Permit, based on the following:
(1) The use is accessory to a permitted use in the OS-1 district.
(2) The residence does not occupy the front half of the ground floor of the building or over one half (1/2) of the total square footage of the building.
(3) Off street parking is provided on the lot as required by Article 5 of this Ordinance.
(4) The residence must meet the minimum square footage for apartments required by Article 153.402q.
The language “The use of a portion of an office as an accessory residence” would be inserted under District Regulations, and would require a Special Use Permit.
Bow continued by stating that 153.402q. was put in place due to multiple residences not meeting a certain minimum square footage. Under 153.402q., the minimum floor area requirement for apartments is spelled out, as is the minimum floor area requirement for single family dwelling units and duplexes (900 square feet per dwelling unit). He added that we have had some homes with fifteen to twenty (15-20) individuals in one home.
The Chairperson opened the public hearing to the audience.
Donald Drumm – stated that, as long as it wouldn’t restrict the issuance of a Special Use Permit, he doesn’t see that square footage as a problem. He added that half of the building sounds reasonable.
The Chairperson closed this portion of the public hearing.
Borgerding – inquired as to whether the Special Use Permit would go to the person or the property, and City Manager Bow stated the property.

Office/Residential Joint Uses – It was moved by Olson, and seconded by Gault, to recommend that the City Council approve the language, modifying the District Regulations and Standards provisions of the Flushing Zoning Ordinance, as indicated.

Keane – wished to remind administration to correct the two (2) typographical errors in the supporting documents prior to forwarding them to the City Council.
