A Regular Meeting of the Flushing City Council was called to order on Monday, June 8, 2009 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

St. Robert Bellarmine Catholic Church – Motion by Kozan, seconded by Brock, to approve St. Robert Bellarmine Catholic Church’s request to hold a procession on June 14, 2009 starting at 12:35 p.m. on Cherry Street, proceeding to McKinley, Elm and then back to the church.

REPORTS:

 

2008-2009 Budget Adjustments – Motion by Gault, seconded by Bade, to adopt the fiscal year 2008-2009 budget adjustments, as presented by the Clerk/Treasurer.

Code Enforcement – The City Manager reviewed the procedure for dealing with blight conditions in the city.

 

Taste of the Trail Event - A group of volunteers requested city support for a fundraising event to support Riverview Trail’s maintenance, expansion and for trail awareness.  The event is entitled “Taste of the Trail,” and is proposed to be held on Saturday, August 8, 2009 from 4:00 p.m. to 7:00 p.m.  The event will enable patrons to sample local restaurant offerings for an entry fee of Ten ($10.00) Dollars. At this time, there are ten (10) restaurants willing to donate their time and food.  The event is scheduled to take place along the trail, just east of the city’s cold storage building.  Vendors will park in a field off of Industrial Drive, and will serve patrons using the trailway.  Permission is requested to hold the event with the Department of Public Works’ assistance for trash removal.

 

            Motion by Szukhent, seconded by Gault, to approve the Taste of the Trail Event, subject to coordination with city department staff, and without the use of any motorized vehicles (including golf carts) to be located on the trail.

ITEMS FOR FUTURE PUBLIC HEARINGS:

 

State Revolving Fund – Waste Water Treatment Plant – Motion by Salem, seconded by Bade, to set a public hearing date of Monday, June 29, 2009 at 7:30 p.m. at City Hall, 725 E. Main Street, on an application to the State Revolving Fund for upgrades to the Waste Water Treatment Plant.

BID/AWARD PURCHASES:

 

Solid Waste Contract - Three (3) bids were received for the solid waste contract that is due to expire on June 30, 2009.  The bid specifications reflect the following:

 

-           A five (5) year contract term is requested.

-           Residential services include mixed waste, commingled recycling, and compost collection and processing.  As in the past contract, the contractor is responsible to bulk load stockpiled leaves for removal, provide containers for commingled recyclables, and provide bulk item collection and disposal.

-           The commercial pickup requires a daily pickup in the downtown area, as well as provisions for handling cardboard and the compactor.  In addition, several dumpsters are to be provided at various locations and dates throughout the year, for use by the Department of Public Works.

-           Payment schedules are requested, per month, for five years ending June 30, 2014.

 

The proposals were received from Waste Management, Republic Services, Inc., and Richfield Equities, LLC.  The low bidder was Waste Management with the following lump sum schedule:

During the contract term with Waste Management, the company has been very responsive to requests for service in the City, and I would highly recommend retaining their services as proposed.  According to the results of the recently completed survey, their services ranked number one in all services provided by our city.

 

Motion by Gault, seconded by Szukhent, to accept the bid proposal for solid waste collection services from Waste Management for the period July 1, 2009 through June 30, 2015.

Sale of 1984 Chevrolet Pump Truck - Due to a lack of use, and changes to fire responses, the Fire Chief recommended that a 1984 Chevrolet Pump Truck be sold.  This vehicle is rarely utilized, and the space in the fire station is needed to house a trailer that is used to transport an inflatable boat, as well as an all-terrain vehicle (ATV). 

 

In accordance with Section 36.25 (a) (2), personal property having a value in excess of One Thousand ($1,000.00) Dollars, may be sold only after approval of the City Council.  That approval made, shall specify the terms of the advertisement, the bidding process, and may include auction services.  Administration recommended advertising this vehicle in both The Flint Journal and the Michigan Municipal League (MML) web page, requesting sealed bids.

 

            Motion by Bade, seconded by Salem, to authorize administration to advertise and accept sealed bids for the sale of a 1984 Chevrolet Pump Truck.

2009 Street Paving Project - Bids were received to complete this year’s street paving project.  The low bidder was Lois Kay Contracting, of Saginaw, Michigan.  As all of the bids exceeded the budget amount that has been allocated this year through our Capital Improvement Program, administration reviewed the proposed street paving list, and recommends the following streets for this year’s project:

 

            Park Avenue                            Boman Street

            Cynthia Drive                           Mark Drive

            Kim Court                                Schillman Place

            Circle Drive                                         

 

The contract bid price for the above listed roads is Four Hundred Sixty-Nine Thousand, Nine Hundred and Ninety-Six ($469,996.23) Dollars and twenty-three cents. 

 

Lois Kay Contracting has worked on several projects for the city in the past, and has satisfactorily completed those projects within the timeframes scheduled, and in a manner that was acceptable to the city administration.  Administration recommended awarding the contract to Lois Kay Contracting.

An alternate bid was requested for the paving of Terrace Street.  That alternate bid was included in the amount of One Hundred Nineteen Thousand, Three Hundred Thirty-Eight ($119,338.65) and sixty-five cents.  In the event that additional stimulus monies are released by the State of Michigan, it is administration’s recommendation that Terrace Street be added to the listing of streets to be paved this year.

 

Motion by Gault, seconded by Salem, to award the 2009 Street Paving Project to Lois Kay Contracting, Saginaw, Michigan, in an amount not to exceed $469,996.23.  In addition, if the State of Michigan releases additional stimulus dollars that would be available for the paving of Terrace Street, that street should be added to the award.

Bank Stabilization – Motion by Bade, seconded by Gault, to approve the bid from Oak Construction Corporation in the amount of One Hundred Nineteen Thousand ($119,000.00) Dollars to complete the “outfall repair” at Main and Chestnut Streets, per Rowe Professional Services Company’s drawings and notes.  Project to include guardrail removal and replacement, approximately 1,800 square feet of steel sheeting with drain tile, also, tree removal, rip rap and site grading, seed and mulch.  Project to be financed through a loan from General Fund to be repaid from 2009-2010 Capital Improvement tax levy.

ORDINANCES:

 

Café Ordinance - Since the adoption of the 2002 amended Zoning Ordinance, outdoor dining establishments have been prohibited, as an accessory use to a restaurant.  During the past year, requests have been made to consider revising this policy and develop a mechanism, which would allow outdoor dining adjacent to existing restaurants.

The Planning Commission discussed the type of ordinance that would be required to allow this type of use, and held a public hearing to receive public comment on verbiage that has been developed.  At the June Planning Commission meeting, a motion was approved requesting the City Council to adopt an Outdoor Café Ordinance.  This ordinance, as modified by the city attorney, would not become a part of the Zoning Ordinance.  Rather, this is recommended as an additional police powers type of ordinance, to be included under the section of our Code of Ordinances dealing with business regulation.

 

Motion by Szukhent, seconded by Bade, in concurrence with the Planning Commission’s recommendation, to approve the first reading of the Outdoor Café Ordinance.
