A Regular Meeting of the Flushing City Council was called to order on Monday, October 12, 2009 at 7:30 p.m. by Mayor Janice L. Gensel, followed by the Pledge of Allegiance to the Flag and invocation.

MEETING

Consent Agenda - Motion by Szukhent, seconded by Salem, to approve City Council Minutes, as amended, (September 14, 2009 Regular Meeting) and October 12, 2009 Council Bills List.

COMMUNICATIONS:
Genesee County Road Commission/Notice of Public Hearing – The Genesee County Road Commission has announced that the public meeting, open-house and input session for the Elms Road Reconstruction Project from Potter Road to Flushing Road will be held on October 22, 2009 from 6:00 p.m. to 9:00 p.m. at the Flushing Charter Township Municipal Center. The purpose of the meeting is to share information and get public input regarding the proposed reconstruction of Elms Road from a 4 lane to a 3 lane roadway.

The project is presently under design. Actual construction work will begin in June of 2010, with the goal of being completed by September 2010. This schedule will have the road construction occur outside of the school schedule. The road will be closed to through traffic during construction with a posted detour route.
Reconstruction of this heavily traveled corridor is expected to cost over seven hundred thousand dollars. It is being primarily funded through the federal 2009 Reinvestment and Recovery Act funds administered through the Michigan Department of Transportation and the Federal Highway Administration and the Genesee County Road Commission.
Flushing Area Chamber of Commerce/Candlewalk – Motion by Salem, seconded by Kozan, to approve the Flushing Candlewalk Committee’s request to hold the 26th Annual Flushing Community Candlewalk on Thursday, December 3rd, and Friday, December 4th. Main Street to be closed to through traffic December 3rd from 5:00 p.m. to 10:00 p.m. from the point at Chamberlain and Main Streets to the corner of Maple and Main Streets. Main Street to be closed to through traffic December 3rd from 5:00 p.m. to December 4th at 10:00 p.m. from Cherry to Maple, with the condition that the school system approves.

American Recovery and Reinvestment Act Grants – Authorized Representative – Motion by Bade, seconded by Szukhent, to designate the city manager as the authorized representative to sign agreements in connection with grants applied for and obtained by the city under the American Recovery and Reinvestment Act.

Tree Trim/Removal – Motion by Gault, seconded by Bade, to award the bid to provide tree and stump removal of twenty-five (25) trees to Great Lakes Tree Experts in the amount of $5,675.00.

1984 Pump Truck – Motion by Gault, seconded by Szukhent, to authorize administration to use the E Bay internet site for purposes of selling a 1984 Chevrolet Mini Pump Truck, and set a minimum reserve price of $1,500.00.

ORDINANCES:
Water Ordinance Amendment/Backflow Prevention – Motion by Gault, seconded by Bade, to move to first reading, an addition to the Water Ordinance No. 53:
Section
53.36. Backflow Prevention Assemblies.
All
testable backflow prevention assemblies shall be tested at the time of
installation or relocation and after any repair. Subsequent testing of devices shall be
conducted at a time interval specified by the city manager, or his/her
designee, and in accordance with Michigan Department of Environmental Quality
requirements. Only individuals that hold
a valid Michigan plumbing license, and have successfully passed an approved
backflow testing class, shall perform such testing. Each tester shall also be approved by the
City of Flushing. Individual(s) performing assembly testing shall certify the
results of his/her testing.
