A Regular Meeting of the Flushing City Council was called to order on Monday, April 12, 2010 at 7:30 p.m. by Mayor George G. Kozan, followed by the Pledge of Allegiance to the Flag and invocation.

REPORTS:

 

Transfer Ownership of 2009 Class C Liquor License – Motion by Martus, seconded by Szukhent, to approve a resolution transferring a 2009 Class C license located at 240 W. Main Street from Flushing Bar & Grill, LLC to Johnny’s Pour House, LLC, which includes the addition of a dance-entertainment permit for weekdays from 7:00 a.m. to 2:30 a.m. and Sundays from 7:30 a.m. to noon.

State of Michigan Liquor Control Commission – On Premise License, Skip’s Come Back Inn, Inc. – Motion by Martus, seconded by Gault, to adopt a resolution to approve an outdoor service area in front of 111 E. Main Street, Flushing, Michigan, 48433, in conjunction with a 2002 Class C license.

Resolution Approving State of Michigan Funding Agreement (ARRA) – Motion by Gault, seconded by Szukhent, to approve Resolution No. 10-0412 designating the Mayor and City Clerk/Treasurer as authorized officials to sign Michigan Department of Transportation (MDOT) Contract No. 10-5229, as related to Terrace Street.

PURPOSE:

 

To establish standard guidelines for the sale of beer and/or wine, by a concessionaire, at specifically designated recreation centers licensed by the City of Flushing.

 

STATEMENT OF STANDARD GUIDELINES:

 

The following are standard guidelines issued by the City of Flushing for regulating the use of alcohol in specifically designated recreation centers.

 

  1. A duly authorized civic, non-profit organization may apply for a license to sell beer and/or wine on city property.  Said application will be made in writing and addressed to the Flushing City Council, 725 E. Main Street, Flushing, MI 48433.

 

  1. Sale of beer and/or wine shall be made only in individual drinks, not in original packages, or otherwise in bulk, and shall be served for consumption only in a designated area, as outlined by the applicant, and approved by the City Council.

 

  1. Any area for which alcoholic beverages are to be sold or consumed must be delineated on a scaled drawing.  Said drawing shall provide dimensions of the area to be used, along with the location on city property that the applicant requests to use.

 

  1. A perimeter double fence, at least six (6’) feet high and eight (8’) feet apart will be required to be maintained around any area in which alcohol is to be sold and/or consumed.

 

  1. Occupancy numbers will be determined by the Flushing City Fire Chief after review of the submitted application.

 

  1. Beer and/or wine may be available for purchase for patrons of legal drinking age.  At least one (1) TIPS trained server must be behind the service area at all times.  No minors are to be allowed within the delineated consumption area.

  1. The applicant must make a cash deposit in an amount to cover the cost of required police protection that the city deems necessary to be present at the event.  The deposit amount will be determined by the City Council after a recommendation by city staff is provided.

 

  1. A Certificate of Liability Insurance, from an approved insurer, shall be submitted with the application in an amount not less than $5 million dollars per occurrence.

 

  1. The City Council may impose any other restrictions, as deemed necessary, to protect the public and promote the health and welfare of the Flushing community.

Flushing Area Chamber of Commerce Request for Beer Sales at the 2010 Summer Fest – Motion by Gault, seconded by Martus, to approve the request by Flushing Area Chamber of Commerce to sell beer “only,” in a fenced area, to consumers who present valid ID’s at the 2010 Summer Fest, contingent upon an approved site plan being submitted to the city (Any area for which alcoholic beverages are to be sold or consumed must be delineated on a scaled drawing.  Said drawing shall provide dimensions of the area to be used, along with the location on city property that the applicant requests to use.), and they must make a cash deposit in an amount to cover the cost of required police protection that the city deems necessary to be present at the event.

Sewer Rates – Motion by Gault, seconded by Salem, to adopt Resolution No. 10-0412-B, setting the sewer debt service rate at $5.00/quarter, per residential equivalent unit, effective for billings sent after May 1, 2010.

BID/AWARD PURCHASES:

 

Financial Audit – Motion by Salem, seconded by Gault, to accept the audit services of Lewis and Knopf, P.C. for auditing services for the three fiscal years ending June 30, 2010, 2011, and 2012, and recognizing the option to continue the auditing services for fiscal years 2013 and 2014 for an amount not to exceed Fifteen Thousand ($15,000.00) Dollars per year, and upon the city council’s approval of said extension.

Adoption of Uniform Traffic Code to Add Section 70 – Motion by Szukhent, seconded by Salem, to move to second reading and adoption of an amendment to Ordinance 70, adding Section 70.01(f) to adopt, by reference, the Uniform Traffic Code for Cities, to be used in conjunction with the Michigan Motor Vehicle Code.

Sign Ordinance Amendment – Motion by Szukhent, seconded by Gault, to move to first reading an amendment to Section 156.15.1, Non-Conforming Existing Signs, of the city’s Sign Ordinance.  The amendment allows, in certain instances, the re-painting of a sign face, or the replacement of a removable panel on an existing sign, without requiring replacement of the entire sign.
