A Regular Meeting of the Flushing City Council was called to order on Monday, June 14, 2010 at 7:30 p.m. by Mayor George G. Kozan, followed by the Pledge of Allegiance to the Flag and invocation.

Approval of Agenda - Motion by Gault, seconded by Salem, to approve the June 14, 2010 agenda.

PRESENTATIONS:

 

Capital Improvement Committee – Reclamation of 309 E. Main Street – Dr. Michael Witt, representing a group of Flushing individuals, presented a proposal to reclaim and restore the former city hall, located at 309 E. Main Street.  A public hearing will be scheduled in order to receive public comment on the proposed plan.

Consent Agenda - Motion by Szukhent, seconded by Gault, to approve City Council Minutes (May 10, 2010 Regular Meeting), City Council Minutes (May 10, 2010 Closed Session), and June 14, 2010 Council Bills List.

REPORTS:

 

Construction Engineering – 2010 Street Paving Program – Motion by Szukhent, seconded by Salem, to approve Rowe Professional Services Company’s construction engineering proposal for the 2010 Street Paving Program (Terrace Street, McKinley Road and James Connis) in an amount not to exceed Forty-Nine Thousand, Ninety ($49,090.00) Dollars, with the understanding that billing will be based upon the project construction length.

2009-2010 Budget Adjustments – Motion by Gault, seconded by Keane, to adopt the fiscal year 2009-2010 budget adjustments as presented.

            Nay:     None

            Motion Carried.

 

Kathy’s Outdoor Café License Renewal – Motion by Szukhent, seconded by Salem, to approve the application for a license for an outdoor café for Kathy Birchmeier, doing business as Kathy’s Restaurant, at 126 E. Main Street, provided that the additional two (2) tables do not extend in front of any other businesses or residences, and that the fence is five (5’) feet from the back of the curb, and that she complies with all conditions of the ordinance.

Canoe Launch Rules and Guidelines – Motion by Szukhent, seconded by Salem, to approve the following conditions, as recommended by the Parks and Recreation Committee:

 

-                     Hours of operation are to be –dawn to dusk

-           No long term, or overnite parking at this time.  Parking lot suggested to be developed and funded by the walleye committee.

-                      No alcoholic beverages allowed.

-                      Minimum of two (2) posts to be placed in drive, half way to two thirds of the distance to the water, to prevent cars from going into the river.

-                      Sign stating, “watercraft must be carried to the water”.

-                      Port-a-john or an improved fix site unit to be placed near ramp area (funding for the fixed site unit would need further discussion).     

-                      Waste receptacle for trash is to be maintained.

-                      Fishing would be allowed.

-                      Watercraft will have the right-of-way over fishing.

-                      Area behind the chain to the lift station would be designated as “closed to the public” under sec 97.06 of the flushing parks rules. Sign needed that states “no entry behind this point”.

-                      “Park entrance” sign posted along river road as traffic warning.

ORDINANCES:

 

Zoning Ordinance Amendment – Motion by Szukhent, seconded by Brock, to approve a second reading and adoption of an amendment to the Zoning Ordinance, adding Section 153.901(AY)(8) to the Zoning Ordinance, and postponing action on Section 153.901(BB).

 

            Yea:     Brock, Gault, Keane, Martus, Salem, Szukhent, Kozan

            Nay:     None

            Motion Carried.

 

APPOINTMENTS:

 

Flushing Area Senior Center – Board of Directors – Motion by Szukhent, seconded by Martus, to appoint Paul Blanchard to the Flushing Area Senior Citizen Center’s Board of Directors.

            Nay:     None

Flushing Planning Commission – Motion by Gault, seconded by Brock, to confirm Councilperson Gault’s appointment of John Daly to the Planning Commission.

            Motion Carried.

 

Flushing Planning Commission – Motion by Salem, seconded by Brock, to confirm Councilperson Salem’s appointment of Richard Bade to the Planning Commission.

            Motion Carried.

 

CLOSED SESSION:

 

Purchase of Real Estate – Motion by Szukhent, seconded by Gault, that, pursuant to the Open Meetings Act compiled laws 158.268(d), to go into closed session to discuss the purchase or lease of real property, or to consider the option to purchase or lease real estate.
